User:Universal Omega/Terms of Service

Effective Date of this policy: this policy became effective on May 27, 2023.

1. Terms

By accessing this web site, you are agreeing to be bound by these web site Terms and Conditions of Service, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site. The materials contained in this web site are protected by applicable copyright and trademark law.

2. Copyright Violations

By using services provided by WikiForge, you agree not to host any content without explicit permission from the copyright holder or any other legal entitlement to use the content. This applies to both private and public Wikis.

In the event of unauthorized copyrighted material being found, you may report the contents to us via [email protected]. We strive to comply with the provisions outlined in the Digital Millennium Copyright Act (DMCA) of the United States, which addresses copyright infringement on the internet. As the enforcement action and liability generally lie with the copyright holder under Section 512 of the DMCA, we hold no obligation to act on copyright requests unless requested by the copyright holder. WikiForge will act on complaints if it determines an unreasonable or unacceptable delay in handling non-legal requests to protect creative rights.

We encourage all users to respect intellectual property rights and ensure that any content uploaded to WikiForge complies with copyright laws. If you believe your copyrighted material has been used inappropriately on WikiForge, please provide us with the necessary information to process your complaint, including:

  1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  2. Identification of the copyrighted work claimed to have been infringed.
  3. Sufficient information to locate the infringing material on WikiForge.
  4. Contact information of the copyright owner or authorized representative.
  5. A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information provided in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the copyright owner.

Upon receipt of a valid copyright infringement notification, we will promptly investigate the matter and take appropriate actions, which may include removing or disabling access to the infringing material. We may also notify the user who posted the allegedly infringing material and provide them with an opportunity to respond.

By using WikiForge, you acknowledge and agree to comply with the DMCA and respect the intellectual property rights of others. Any repeated infringement of copyright may result in the termination of a user's account and all associated services without refund or other appropriate legal actions.

3. Privacy

You agree to review and accept WikiForge's Privacy Policy.

4. Refunds

You agree to review and accept WikiForge's Refund Policy.

5. Disclaimer

The materials on WikiForge's web site are provided "as is." WikiForge makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Furthermore, WikiForge does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its Internet web site or otherwise relating to such materials or on any sites linked to this site.

6. Limitations

In no event shall WikiForge or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on WikiForge's Internet site, even if WikiForge or a WikiForge authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

7. Revisions and Errata

The materials appearing on WikiForge's web site could include technical, typographical, or photographic errors. WikiForge does not warrant that any of the materials on its web site are accurate, complete, or current. WikiForge or its users may make changes to the materials contained on its web site at any time without notice. WikiForge does not, however, make any commitment to update the materials.

8. Price Changes

WikiForge reserves the right to modify the pricing of its services at any time without prior notice. Any changes to the prices of the services will become effective immediately upon being updated on the WikiForge website. By continuing to use the services after a price change, you agree to the new pricing terms.

While we strive to provide accurate and up-to-date pricing information, there may be instances where errors or discrepancies occur. In such cases, WikiForge reserves the right to correct any pricing errors and adjust the charges accordingly. If you have been charged an incorrect amount, please contact our sales team at [email protected] for assistance.

It is your responsibility to review the current pricing information before purchasing or renewing any services on WikiForge. We recommend regularly checking the pricing page or contacting our sales team for the most accurate and current pricing details.

Please note that any discounts, promotions, or offers provided by WikiForge may have specific terms and conditions associated with them. These terms and conditions will be clearly stated in the respective promotional materials and should be reviewed before availing of any discounted services.

WikiForge shall not be liable to you or any third party for any direct or indirect damages or losses arising from price changes or errors in pricing information.

If you have any questions or concerns regarding pricing or billing, please reach out to our sales team for assistance.

9. Content

Under no circumstances are you permitted to submit information to WikiForge that is illegal to display, distribute, or disseminate in the United States. In addition to this, WikiForge does not host:

9.1 Wikis which spread unsubstantiated insult, hate or rumours against a person or group of people.

Content on wikis must be fairly balanced, meaningful or substantiated by independent referencing. Wikis which have a clearly identifiable comedic or satire value are exempt from needing to substantiate claims as these provide a meaningful value in terms of relevant content. Exceptions for comedy/satire do not cover derogatory language based on factors such as race, ethnicity, gender, sexual orientation, religious affiliation, age, disability, or other marginalised groups.

9.2 Wikis where the community has developed in such a way as to be characterised as toxic.

This may include wikis where there have been repeated personal attacks, harassment of users, 'doxing', hate speech and where local administrators have ignored, enabled, and/or done little to stop this.

9.3 Wikis of a sexual nature which involve minors in any way.

Whether content is of a sexual nature and whether it involves minors will be determined by reference to all the circumstances and descriptions. Content includes written content, real images and animated or fictional images. Where a wiki's scope as a whole is not of a sexual nature which involves minors, references and discussions about outside content are permitted as long as they are legal under United States law. Wikis which focus on fetishes that are sexual in nature which involves minors are not allowed. This includes written, real images and animated/fictional material.

9.4 Wikis that promote violence, hatred, or harassment against a person or group of people.

This include wikis which promote violence or hatred against people or groups of people based on factors such as race, ethnicity, gender, sexual orientation, religious affiliation, age, disability, or other marginalised groups. Derogatory language based on these factors is not allowed except when relevant to documenting an event, e.g. controversy about the inclusion of derogatory terms in a book.

9.5 Wikis with the sole purpose of deceiving, defrauding, or misleading people.

Wikis which wilfully engage in deceiving, defrauding, or misleading people are prohibited. Wikis are prohibited from engaging in disinformation, misrepresenting information purposefully to deceive and defraud, or from concealing their origin in order to mislead users on their intentions. Wikis may not engage in impersonating any person or organisation. Misleading claims on health which have the potential to cause serious harm to people or public health are prohibited. This is not an exhaustive list of practices deemed deceptive but helps illustrate what sorts of behaviours are. Wikis which make it clear that their intention is not to deceive (which may include fantasy world, role-playing, etc.) would not fall into a violation of this policy.

9.6 WikiForge additionally reserves the right to terminate services for wikis which make it difficult for other wikis.

Things which have a tendency to draw unwelcome attention to WikiForge, such as hate speech, routine denial of service attacks, excessively violent content, references to self-harm, or places in which illegal activity is discussed can create conditions that penalise other wikis, either in SEO, domain blacklisting, downtime, trust in WikiForge, or excessive Staff time usage, especially in terms of policing content.

10. Global Conduct

The following conduct is prohibited:

10.1 Harassment

Harassment of other users is unacceptable. In order for something to fall under this section, it usually requires a pattern of behavior rather than a single instance or event, but in some instances a single instance may be enough. Harassment defined in this policy includes those set forth below, but are not limited to Personal attacks, violence, threats of violence, or deliberate intimidation. Offensive, derogatory, or discriminatory comments.

  • Gratuitous or off-topic use of sexual language or imagery.
  • Inappropriate or unwanted public or private communication, following, or any form of stalking.
  • Disclosure or threatening to disclose a person's identity or other private information without their consent. Disclosure of some identifying information is not consent to disclose other identifying information.
  • Inappropriate or unwanted publication of private communications. Publishing or reporting private communication or personally identifying information for the purposes of reporting harassment (as explained here) is acceptable.
  • Discrimination, particularly against marginalized and otherwise underrepresented groups. Targeted outreach to such groups is allowed and encouraged.
  • Reporting users for purposes other than reporting genuine violations of global policies (e.g., retaliating against a reporter or victim by filing a report claiming their response was harassment).
  • Repeated failures by wiki administration to handle harassment appropriately despite proper warnings by Staff may lead to intervention.

10.2 Hate speech

Hate speech is not allowed. Examples include but are not limited to using racist, homophobic or other derogatory language towards a person or group of people.

10.3 Personal threats

Personal threats are not allowed. Examples include but are not limited to death threats, threats of injury, threats of violence. This also may include threats that are below the legal threashold.

11. Links

WikiForge has not reviewed all of the sites linked and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by WikiForge. Use of any such linked web site is at the user's own risk.

12. Site Terms of Service Modifications

WikiForge may revise these terms of service for its web site at any time without notice. By using this web site, you are agreeing to be bound by the then-current version of these Terms and Conditions of Service.

13. Governing Law

Any claim relating to WikiForge's web site shall be governed by the laws of the United States, without regard to its conflict of law provisions.

14. Termination and Modification of Services

WikiForge reserves the right to modify, suspend, or terminate the services provided on its website at any time, with or without notice, for any reason. This includes, but is not limited to, the availability of features, databases, or content. WikiForge shall not be liable to any user or third party for any modification, suspension, or discontinuation of the services.

Wiki owners are responsible for upholding the Terms and Conditions of Service and ensuring that the content hosted on their wikis adheres to the guidelines outlined in Section 9 and Section 10. In the event of extenuating circumstances or repeated or serious violations of the Terms and Conditions of Service, WikiForge staff may step in to enforce compliance and take necessary actions, including content removal, wiki deletion, service termination, or other measures deemed appropriate.

Failure to comply with the Terms and Conditions of Service, including the hosting of prohibited content or the creation of a toxic community, may result in the termination of services for the affected wiki(s) and may also lead to additional actions as determined by WikiForge.
